BDSM Illegal in Iowa?

I recently read that BDSM is illegal in Iowa , if say, the relationship ends and one partner files a complaint, that it can result in assault/battery charges! Thoughts would be great to hear,facts far more so! From what I read, consent is not a defense to "causing pain" ie spanking etc.

Actually, if you want to get right down to it, BDSM is illegal everywhere. Maybe Iowa has just passed legislation to declare BDSM itself illegal, but the truth of the matter is that anytime one person strikes with their hand or other object another person that is assault and battery. I'm not sure what class felony it is in any particular state (even my own) but the truth of the matter is that yes, BDSM is illegal in all 50 states.

There are a few countries where it is more acceptable, but to say bdsm is illegal lacks nuance, and understanding as to what exact activities are ok legally and what isnt legal. To just say bdsm is illegal isnt accurate. To say some, many activities found in the bdsm world is illegal is more accurate.

There are activities that giving consent for, or having consent to do is not a cover re being prosecuted, and some activities that are acceptable. In many countries anything that leaves serious marks, or marks that dont fade quickly is viewed as assault, and the State will say one cant consent to assault. Sadly though the law on this can be very vague. Hows this for guiding legalese.... marks that are of a trifling and transitory nature. What exactly does that mean? In America some States have it that anal sex and giving a blow job is still illegal, things that elsewhere are viewed as being perfectly ok, if done consensually. So what cover is there re using whips, floggers etc, never mind some of the more extreme activities that happens under the bdsm umbrella, if activity found in many peoples vanilla sex lives is illegal.

Classic cases re this sort of thing are Operation Spanner (1), and Rv Brown (2), and its well worth reading up on these and what is and isnt ok round the world, particularly where you live or travel to for play.

Yes its illegal everywhere.

The one holding the whip gets charged with assault.

The one receiving the whip gets charged with aiding and abetting.

The danger here is when states classify BDSM under sex crimes.

Which not all states do. However if your state does what this means is that you are forced to register as a sex offender- for the rest of your life.

NCSF is working diligently to declassify BDSM as a sex crime.

Thanks, Harlequin. I'm pretty sure the Supreme Court struck down homosexual-only sodomy laws in Lawrence v. Texas, so if those are still on the books anywhere they're invalid. I guess sodomy laws that apply to everyone (i.e. don't single out a particular group) are still enforceable, if not enforced.

Technically it is illegal in Connecticut to do it in any position outside of missionary. And technically it is legal in Georgia to beat your wife. But only on Sundays on the steps of capital building.

Stupid laws exist, the real question is whether or not someone will prosecute and a judge won't through it out in a fit of laughter.
